Afterglow Market LLC (“AGM”) is sensitive to the concerns that you have about the use of the information that you disclose to AGM via its website, social media accounts, messaging services, and other means. Accordingly, this Privacy Policy (the “Policy”) sets forth AGM’s privacy practices and the possible uses of the information that it gathers. AGM will not sell, share, or rent your information to others in ways different from those disclosed in this Policy.

Collection of Your Information
In connection with your communications and other interactions with AGM and/or its website, AGM may request and/or collect certain personal information from you, which may include, without limitation, your personal name, business name, address, phone number, email address, credit card information, bank account information, geographic location, and geopositional data (collectively, “Your Information”). You expressly consent to AGM’s use of Your Information for purposes discussed herein.

Use of Your Information
AGM will use Your Information to: (a) fulfil an order that you place; (b) communicate with you; (c) send you promotional and/or other marketing information about products, services, and offerings; (d) administer and support its website; (e) administer and support its Afterglow Balance Program; (f) better understand your needs and how AGM can improve its products and services; (g) monitor the usage of its website; (h) process payments; (i) carry out its obligations and enforce its rights arising relating to billing and collection; and (j) accomplish any other purpose with your consent.

Transfer of Your Information
Your Information may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. If you are located outside the United States, please note that AGM transfers Your Information to the U.S. and processes it there . In addition, AGM may use service providers in other jurisdictions who will have access to Your Information. Your consent to this Policy followed by your provision of Your Information to AGM represents your agreement to that transfer. AGM will take all the steps reasonably necessary to ensure that Your Information is treated securely and in accordance with this Policy and no transfer of Your Information will take place unless there are adequate controls in place to ensure the security of Your Information.

Disclosure of Your Information
AGM may disclose Your Information in the following instances or to the following persons: (a) if AGM is required to disclose Your Information by law or in response to valid requests by public authorities; (b) if AGM is involved in a merger, acquisition or asset sale, in which case, AGM will provide you notice before Your Information is transferred and becomes subject to a different Privacy Policy; (c) to AGM’s subsidiaries and affiliated companies; (d) to contractors, service providers, and other third parties AGM uses to support its business; (e) for any other purpose disclosed by AGM when you provide Your Information; (f) with your consent in any other cases; and/or (g) if AGM believes disclosure is necessary or appropriate to protect the rights, property, or safety of AGM, its customers, or others.

Security of Your Information
The security of Your Information is important to AGM, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While AGM strives to use commercially acceptable means to protect Your Information, AGM cannot guarantee its absolute security.

Your Data Protection Rights under the California Consumer Privacy Act (CCPA)
If you are a California resident, you are entitled to learn what data AGM collect about you, ask that AGM delete your data, and/or ask that AGM not sell or share it. To exercise your data protection rights, you can make certain requests and ask AGM what personal information it has about you. If you make this request, AGM will provide you with:

• The categories of personal information it has collected about you.
• The categories of sources from which it collects your personal information.
• The business or commercial purpose for collecting or selling your personal information.
• The categories of third parties with whom AGM shares personal information.
• The specific pieces of personal information AGM has collected about you.
• A list of categories of personal information that AGM has sold, along with the category of any other AGM who the information was sold it to. If AGM has not sold your personal information, it will inform you of that fact.
• A list of categories of personal information that AGM has disclosed for a business purpose, along with the category of any other company who the information was shared with.

Please note, you are entitled to ask AGM to provide you with this information up to two times in a rolling twelve-month period. When you make this request, the information provided may be limited to the personal information AGM collected about you in the previous twelve months.

If you request that AGM delete your personal information, AGM will do so and direct any service providers to do the same. In some cases, deletion may be accomplished through de-identification of the information. If you choose to delete your personal information, you may not be able to use certain functions of AGM’s website that require your personal information to operate.

Please note, if you ask AGM to delete or stop selling your data, it may impact your experience with AGM’s website, and certain functionality of the website that require the usage of your personal information to function may not work. But in no circumstances, will AGM discriminate against you for exercising your rights.

Service Providers
AGM may employ third party companies and individuals to facilitate the sale of its goods (“Service Providers”), provide services or goods on AGM’s behalf, or assist AGM in analyzing how its website, goods, and services are used by consumers. These third parties have access to Your Information only to perform these tasks on AGM’s behalf and are obligated not to disclose or use it for any other purpose.

Microsoft Clarity and Microsoft Adverting
AGM partners with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with AGM’s website through behavioral metrics, heatmaps, and session replay to improve and market AGM’s products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, AGM uses this information for site optimization, fraud/security purposes, and advertising. Links to Other Sites
AGM’s website and social media accounts may contain links to other sites that are not operated or controlled by AGM. If you click a third-party link, you will be directed to that third party's site. AGM strongly advises you to review the Privacy Policy of every site you visit. AGM has no control over and assumes no responsibility for the content, privacy policies or practices of any third-party sites or services.

Children’s Privacy
AGM’s website and social media accounts are not intended for use by children under the age of eighteen (“Child” or “Children”). AGM does not knowingly collect personally identifiable information from Children under eighteen. If you become aware that a Child has provided AGM with personal data, please contact AGM. If AGM becomes aware that it has collected personal data from Children without verification of parental consent, AGM will take steps to remove that information from its servers.

Changes to This Policy
AGM may update the Policy from time-to-time. AGM will notify you of any changes by posting the new Policy on this page. AGM will let you know via email and/or a prominent notice on its website, prior to the change becoming effective, and update “effective date” at the top of this Policy. You are advised to review this Policy periodically for any changes. Changes to this Policy are effective when they are posted on this page.
